The rules to be eligible to take this refundable payroll tax credit are complex. This resource library will help you understand both the retroactive 2020 credit and the 2021 credit.
Note: Per the Infrastructure Investment and Jobs Act, the ERC ends early, making wages paid after Sept. 30, 2021, ineligible for the credit (except for wages paid by an eligible recovery startup business). IRS Notice 2021-65 provides guidance on the repayment of payroll taxes related to an anticipated ERC taken before this law was passed and also provides ERC information related to recovery startup businesses.
