The borrower defense rules finalized by the U.S. Department of Education (ED) on September 23, 2019, will continue to have significant implications for institutions that receive Title IV funds. This is true regardless of whether these institutions meet the Title 2 U.S. Code of Federal Regulations (CFR) Part 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (Uniform Guidance) audit threshold requirement.
