As a result of a decision of a hearing panel of the Joint Trial Board, effective November 23, 2017, Mr. Berger was admonished and directed to provide his most recent accepted peer review to the Ethic Charging Authority within 30-days of the hearing panel’s decision.  Mr. Berger was found guilty of violating Rule 202–Compliance with Standards; Rule 501–Acts Discreditable; and Rule 501-5-Failure to follow requirements of governmental bodies, commissions and other regulatory agencies of the AICPA Code of Professional Conduct in connection with his performance of professional services related to the audit of an employee benefit plan and his failure to ensure his firm obtained an appropriate peer review.
